Please read these terms and conditions of hire before you make a booking. When receiving a booking from you, the Customer, by website, phone or E-mail we will take it that you have read and understood the terms and conditions on this page.

 

INCLUSION POLICY:

Fun On Wheels, LLC does not and shall not discriminate on the basis of race, color, religion (creed), gender, gender expression, age, national origin (ancestry), disability, marital status, sexual orientation, or military status, in any of its activities or operations. These activities include but are not limited to, hiring and firing staff, selection of volunteers and vendors, and provision of services. We are committed to providing an inclusive and welcoming environment for all members of our staff, clients, volunteers, subcontractors, vendors, and clients.

 

PAYMENT POLICY:

A valid credit or debit card is required to book via email/invoice or over the phone to pay for your scheduled event. We do require payment in full at the time the party/event is booked unless discussed otherwise. If booked in person or you add services the day of the party/event we will accept credit/debit card, cash or venmo payments.

 

CANCELLATION/REFUND/RESCHEDULE POLICY:

Rescheduling is always and option and we will accommodate you to the best of our ability at no extra charge. Cancellations made 7 days or more prior to the scheduled party/event will NOT incur a cancellation fee. Cancellations made 3-6 days prior to the event will get a $50 cancellation charge. Cancellations made less than 3 days prior to the event will only be refunded back at 50% of the amount paid for party/event if they do not want to reschedule. Cancellations made the same day as the party/event will not be refunded there is only the option to reschedule for a later date based on availability.

 

TRAVEL SURCHARGE:

Our primary service area is Kittitas county any locations we agree to service outside that area will incur an added travel surcharge. The rate will vary depending on location and distance. It will be disclosed during the booking process before the payment is taken. Or for certain parties/events you may contact us and we can give you the added surcharge cost for your location prior to booking or invoicing. For a list of areas we readily service outside our primary area please refer to our website, email or call us.

 

BAD WEATHER - VIDEO GAME THEATER:

The Fun On Wheels mobile video game theater was designed for all types of weather conditions. The theater is insulated and climate controlled with heat and air conditioning. There may be occasions outside of our control when weather conditions may not cooperate with your scheduled party/event. In the event of hazardous weather (sustained winds over 40mph, flooding, or snow, ice or debris on roadways/driveways) we may need to, and reserve the right to reschedule your party/event to guarantee the safety of you, your guests, our staff and equipment. If the threat of these hazardous weather conditions threatens your party and you are aware in advance (pending or anticipated snow storm or other strong weather event) please contact us to begin the rescheduling process.

BAD WEATHER - GELLYBALL

Fun On Wheels GellyBall events may be outside if they are they can be affected by weather. There may be occasions when the weather does not want to cooperate with your scheduled party/event. In the event of inclement weather (ie; lightning, high winds exceeding 25 mph, flooding, rain, snow & ice, etc.) we may and reserve the right to reschedule your service to guarantee the safety of you, your guests, our staff, and equipment. If we have already arrived at your party location and the weather begins to turn for the worse (example: It starts to rain or the wind becomes severe) we will give you the option to move the party to our game theater at no additional charge or reschedule the party if it hasn't started. If we have already set up and started the party/event the only option is moving to the game theater or we can leave early if requested. If the threat of these weather conditions threatens you party and you are aware in advance (pending or anticipated major storm or another strong weather event) please contact us to begin the rescheduling.

 

SUPERVISED CHILDREN GAMING TRAILER:

For insurance liability and safety restrictions children under the age of 7 will not be permitted inside the gaming theater. (This includes siblings)

Ages 1-6 are permitted to be present outside the trailer with parental supervision they may NOT be left unattended in our outdoor gaming station area. This is for the safety of the little ones. We cannot supervise them or protect them from falling off of chairs, crawling under the trailer or going into the street as we are monitoring other gamers inside and out. Please discuss this with all parents coming to your party/event in advance so they know what to expect.

 

Fun On Wheels, LLC does require one parent or responsible adult to be present outside the trailer at all times for children up to age 16. If guests under the age of 18 will not have their parent or guardian on premises, we will need a waiver putting the party host or other responsible adult in charge of them during the party so we have a contact that is on premises should any need for the game coach to contact them arise.

SUPERVISED CHILDREN GELLYBALL:

Children under the age of 6 will not be permitted to participate in GellyBall wars or games due to insurance and safety restrictions. Any children not participating in the GellyBall activities must be a safe distance away from the designated field area. Your game coach will let you know what this distance is at the time of the event. Children over the age of 6 must be able to fit into safety/protective gear correctly and wear it at all times to participate in games.

Fun On Wheels, LLC - GellyBall does always require a parent or responsible adult to be present at and in visual contact of any Fun On Wheels, LLC party/event. The parent or responsible adult must at all times provide supervision of the event. This supervision requires focused attention and intentional observation of children at all times. In the event supervision is not provided, Fun On Wheels, LLC will end the service and depart the location without opportunity for any sort of refund.

 

REFUSAL OF SERVICE:

At Fun On Wheels safety is priority. Fun On Wheels, LLC reserves the right to refuse service to the client if we observe behavior which we deem to be a potential threat to our employees, guests, or equipment. Such behavior includes, but is not limited to, obvious intoxication, observed or suspected drug use, aggressive language or behavior, unsafe surroundings, etc. In this case, we may refuse to start a party or terminate an ongoing party/event with no refund. ?(If surrounding area is deemed unsafe we may offer the ability to reschedule the party at a different location based on availabililty?)

We reserve the right to refuse gaming to any non-cooperative or uncontrollable guests, or shut down the party if it is deemed out of hand or unsafe with no refund.

 

ALCOHOL/DRUGS:

You may serve alcohol at your event or party, however it will not be allowed near the equipment or inside the game trailer at anytime. You must also designate a sober point of contact at the beginning of the party/event. They must stay sober the entire event.

For larger events 50 or more, we may require and on-site security surcharge and/or security deposit when alcohol is being served. We also reserve the right to refuse, cancel or cut short any party/event or booking when alcohol is being served and we deem it to be unsafe for our staff or game coaches, due to drunk guests.

 

We have a no tolerance policy for drugs of any sort. They will not be tolerated or allowed anywhere near, around or in the Fun On Wheels Mobile gaming trailer and attached truck. Any observed use of drugs will result in the termination of the party immediately with No Refund.

Smoking is not allowed inside the game trailer or within a 40 foot radius of the outside of the trailer game play area. This is includes all forms of smoking (cigarettes, cigars, vape pens, e-cigarettes, marijuana, etc.) If you are observed smoking in close range of the trailer we will give one warning to stop, if you have to be asked more than once you will be asked to leave.

 

GENERAL RELEASE/INDEMNITY/HOLD HARMLESS:

You, The customer will take all necessary precautions regarding the items rented/equipment, and protect all persons and property from injury or damage. The customer acknowledges that they are in charge of the operation and are fully responsible for its safe operation. Customer acknowledges and agrees that Fun On Wheels, LLC is not responsible for any injury occurring to the Customer, or any guest of the customer, or to any other person at the event. Customers agree to defend, indemnify and hold harmless Fun On Wheels, LLC from and against any and all liability, claims, judgments, attorney fees, and cost, of every kind and nature, including, but not limited to, injuries, or death to persons. I, the customer understand and acknowledge that playing in, with or around any Fun On Wheels, LLC product or service entails both known and unknown risks including, but not limited to, physical injury from falling, slipping, crashing, or colliding, emotional injury, trauma, paralysis, distress, damage, or death to any participant.

PLEASE ALSO SEE OUR WAIVER AND SIGN IT. WE WILL HAVE THEM AVAILABLE UPON ARRIVAL AT YOUR EVENT AND WE ALSO SEND A COPY VIA EMAIL FOR YOU TO READ PRIOR TO YOUR EVENT AT THE TIME OF BOOKING.

 

DAMAGE/INJURY – VIDEO GAME THEATRE:

Neither Fun On Wheels, LLC nor any of its employees shall be responsible for any damage to property resulting from a request by the client/host to position the trailer in a specific location. This includes both above ground and below ground property/equipment damage. Additionally, Fun On Wheels, LLC reserves the right to charge the client/hosts credit card for damages to the trailer or equipment resulting from the careless or willful damage of same by client/hosts guests. Neither Fun On Wheels, LLC nor its employees assume any responsibility for any injuries sustained on the clients property or their designated location. All liability for damages or injuries are the sole responsibility of the client/host.

Neither Fun On Wheels, LLC GellyBall,  nor any of its employees shall be responsible for any damage to property. This includes both above ground and below ground property/equipment damage including but not limited to grass, plants, animals, buildings, trees, pools, furniture, or any other property. Additionally, we reserve the right to charge the clients credit card for damages to the equipment resulting from the careless or willful damage of same by clients or guests. Neither Fun On Wheels, LLC GellyBall nor its employees assume any responsibility for any injuries sustained on the client’s property or their desginated location. All liability for damages or injuries is the sole responsibility of the client and/or host.

 

FOOD AND DRINKS:

Fun On Wheels, LLC does not allow any food or drinks into the video game theater (this includes gum). Please have your guests consume them outside of the trailer prior to entering. We can provide a table area outside our trailer upon request where your guests can eat if you do not have an area for them. We also request that your children please wash there hands after eating greasy or sticky foods before returning to the Game Theater so we can protect our equipment.

 

PICTURES:

When you party starts we may take a group photo that we will use to send to you and as well as for our social media or website. While your party is in effect the game coach or game coach assistant may be taking pictures of the event from inside or outside of the trailer. We may use these photos for advertisements on flyers or on our social media pages or our website. If you do not want our game coach taking these pictures or posting them online in any form, please contact us prior to the party to let us know or alert the game coach upon our arrival before the party starts. You may request any of these photos from us via email or text.

 

INTERNET POLICY:

Fun On Wheels does provide online gaming and some of our consoles run games on the internet. If you would like fortnite or any other online specific games for your party please let us know at least a few days before your scheduled event so we can be prepared. If you do not notify us in advance we cannot guarantee the online games will be available. We provide mobile Starlink satellite internet service which is available in most locations but does require a clear view of the open sky at your location of choice. We will make every attempt to connect the internet service to our consoles but there may be rare occasions when there is not a strong satellite connection and it will not work. Fun On Wheels is not responsible for guaranteeing a successful internet connection at every party/event or during the entire duration of a party/event. Please note: That inappropriate content or language is outside of our control in an online gaming environment. If you are not comfortable with this please let us know you do not want to authorize online gaming.

 

TIPS:

The game coach is there to make sure your group is making the most of our high tech fun. This service is included in the package you purchase so tipping is not necessary. We do appreciate tips if you feel the service was great but please to not feel obligated to do so.

 

OUR GAME TRAILER:

When the truck pulls up, please keep your guests from running up to the trailer or around it. We will try to park in the most level & flat hard surface area or logical spot to accommodate your party/event. Sometimes, we will park on your neighborhood street, so you might want to let your neighbors know (in case they may object) or let us know if you have a preferred spot for us. We might also have to block a driveway. We ask that you clear any cars that may make it difficult for us to maneuver or park. Please keep in mind that our game coach will not park anywhere that may cause a danger to persons, property or equipment. Our truck and trailer combo is very long and we will need a minimum of 45 feet of space to park. Additionally our game coach will never disconnect the truck from the trailer at a party/event without prior approval nor park off of a hardened surface.

In order for us to come to your location you must have a clear maintained road and driveway free of large debris, plowed during winter and not flooded. The ground must be hard enough for our tires to make it through safely. The driveway must also be wide enough for our vehicle to safely fit and not be to steep. If your road or driveway does not meet these guidelines you may want to arrange an alternative location. Please contact us with any questions you may have regarding your road or driveway conditions.

It is the client/hosts responsibility to provide a safe place for us to park far enough in advance to set up our party/event. In the event we cannot find a safe place to park and your party is cancelled no refunds will be given. We will however allow you to reschedule your event if there is availability.

 

VIDEO GAME RATINGS:

G rated game play goes by the house rules. This means that we will play the games that you allow. The game theater has games of all ratings, and we can accommodate many tastes and levels of play. Contact us and we will work with you prior to the day of party/event to confirm your selections. Prior to starting the party the day of the Game Coach will again confirm any game restrictions. Check out our game library on our website for a list of games we offer.

SECURITY CAMERAS:

For the safety of our game coach and our equipment as well as the safety of our guests, we may sometimes use security cameras on our game theater. There will be one placed inside of the trailer and one or two outside. We will do our best to only angle the outside cameras on our equipment and outdoor play area. We will make every attempt to avoid the clients home or surrounding property with the exception of the location we are parked.  These are used to monitor and/or record all actions and behaviors for the safety of our staff, game coaches and guests. Videos will only be reviewed by Fun On Wheels, LLC and the appropriate authorities such as the local law enforcement, to address rule violations, behavior concerns, or illegal activity. They will also be deleted after the party if there are no incidences throughout the party/event that warrant it needing to be reviewed.
